ACQUISITION OF ITALIAN CITIZENSHIP BY BENEFIT OF LAW: Regulatory Amendments

The 2026 Budget Law (Law of 30 December 2025) introduced changes to Article 4, paragraph 1-bis, letter b) of Law no. 91/1992 on Italian citizenship.

Parents —if at least one is an Italian citizen by birth— can now submit their declaration within three years (instead of one) from the child’s birth, or from when the child’s relationship to the Italian parent is legally recognized (including adoption).

These declarations are now free of charge. This means the €250 fee previously required under Article 9-bis of Law no. 91/1992 is no longer payable. The same exemption applies to the declarations under Decree-Law no. 36/2025, which must be submitted by 31 May 2026.

The new rules apply from 1 January 2026 and do not have retroactive effect. Therefore, the exemption applies only to applications submitted from that date onward, and there will be no refunds for those filed before 31 December 2025.
