Citizenship by descent (ius sanguinis)

  1. NEW REGULATIONS

Decree Law No. 36, issued on 28 March 2025, has introduced    a new approach to the recognition of Italian citizenship by descent (ius sanguinis).

Specifically, anyone born abroad, even before 28 March 2025, who holds another citizenship is considered to have never acquired Italian citizenship, unless one of the following essential conditions is met:

  1. A citizen parent or adopter was born in Italy;
  2. A citizen parent or adopter, born abroad, has been a resident in Italy for at least two consecutive years before the date of birth or adoption of the child;
  3. A grandparent was born in Italy.

The transmission of citizenship through the maternal line is only possible if her descendants were born after the 1st of January 1948.
